Terms of Use

These terms are the agreement between you and Orvion Technologies, a sole proprietorship registered in Delhi, India ("we", "us"), for your use of the Fluento app and this website. They also serve as the end-user licence agreement required by the app stores. By creating an account or using Fluento you accept them. If you do not accept them, do not use Fluento.

1. Who may use Fluento

You must be at least 18 years old and able to enter a binding contract. Fluento is not intended for children. You must not use it if you are barred from doing so under the laws that apply to you.

2. Your account

You need an account to use Fluento. Keep your sign-in details to yourself; you are responsible for what happens under your account. Give us accurate information and tell us promptly at support@fluento.cc if you think someone else has access to it. One account is for one person — do not share or resell access.

3. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Fluento on devices you own or control, for your own learning. You may not copy, modify, reverse-engineer, decompile, extract source code or models from, rent, lease, lend, sublicense or resell the app, except to the extent the law expressly permits regardless of this restriction.

4. What Fluento is, and is not

Fluento is a practice tool. Its coaching, corrections, scores, levels and reports are generated by artificial intelligence and may be incomplete, outdated or wrong.

• Fluento is not a certified language test. The CEFR band it estimates is for pitching your practice, not a qualification. It is not IELTS, TOEFL, PTE, Duolingo English Test or a Cambridge exam, and it has no standing with employers, universities, visa authorities or any examination body.
• Fluento is not a human teacher, tutor or examiner, and does not provide educational, career, immigration, legal, medical or financial advice.
• Do not rely on Fluento for any decision that matters without checking it against a qualified human source.

5. Acceptable use

Do not:

• use Fluento for anything unlawful, or to harass, abuse, defame or threaten anyone;
• submit content that is illegal, hateful, sexually explicit, or that depicts or targets minors;
• record anyone else without their knowledge and consent, or submit someone else's personal data as practice content;
• try to get the AI to produce harmful, illegal or deceptive output, or to reveal its instructions;
• scrape, bulk-download, probe, overload or interfere with the app or our backend, or bypass usage limits, rate limits or paywalls;
• use Fluento's output to build or train a competing product or model;
• automate access, share credentials, or use the service through anything other than the official app.

6. Your content

Your recordings, transcripts and answers remain yours. You grant us a licence to host, process and transmit them, and to share them with the processors named in our Privacy Policy, strictly so we can deliver the features you used. That licence exists only for that purpose and ends when the content is deleted. We do not use your content to train our own models and we do not publish it.

You are responsible for having the right to submit what you submit.

7. Free tier, trial and subscriptions

Free tier. Fluento has a free tier with daily limits per feature. We may change those limits.

Trial. New users may start a 7-day free trial of Fluento Plus. You are not charged during the trial. One trial per person.

Fluento Plus. ₹299 per month or ₹1,999 per year, inclusive of applicable taxes unless stated otherwise at purchase. Prices are shown in the app and may change; a change takes effect at your next renewal and we will tell you first.

Billing. Subscriptions are sold and billed by the Apple App Store or Google Play, not by us. A subscription renews automatically for the same period unless you cancel at least 24 hours before the current period ends. Manage or cancel it in your App Store or Google Play account settings — deleting the app does not cancel a subscription.

Refunds. Because the stores take the payment, refunds are handled under their policies. See Cancellations & Refunds.

If a subscription lapses you keep your account and your data and return to the free tier's limits.

8. Changes to the service

Fluento is under active development. We may add, change or remove features, and we may introduce, raise or lower usage limits. We will not remove a feature you are paying for without telling you.

9. Our intellectual property

The Fluento name, logo, app, design, lesson content, scenarios, word lists, prompts and everything else we created belong to Orvion Technologies and are protected by copyright and trade mark law. These terms give you no rights in them beyond the licence in section 3.

10. Third-party services

Fluento depends on third-party sign-in, AI, speech and hosting providers, listed in the Privacy Policy. Their availability is not in our control, and an outage at one of them can interrupt Fluento.

11. Disclaimers

Fluento is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability and non-infringement. We do not warrant that Fluento will be uninterrupted or error-free, that its output will be accurate, or that using it will produce any particular improvement in your English. Nothing in these terms excludes a right you have under consumer law that cannot be excluded.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, opportunities, goodwill or data, arising from your use of Fluento. Our total liability to you for any claim is limited to the greater of the amount you paid us in the twelve months before the claim, or ₹1,000. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

13. Indemnity

You will indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your misuse of Fluento, or content you submitted that you did not have the right to submit.

14. Suspension and termination

You may stop using Fluento at any time and delete your account from Profile → Delete account. We may suspend or terminate your access if you breach these terms, if we are required to by law, or if we discontinue the service. If we discontinue Fluento entirely we will give reasonable notice and, where you have paid for a period you cannot use, a pro-rata refund through the store that billed you.

15. Governing law and disputes

These terms are governed by the laws of India. The courts at Delhi, India have exclusive jurisdiction, except that if you are a consumer resident elsewhere you keep any right to bring proceedings in your own country of residence where local law gives you that right. Please write to us first — most things are settled by email.

16. App store terms

If you installed Fluento from the Apple App Store, you acknowledge that:

• this agreement is between you and us, not Apple, and Apple is not responsible for Fluento or its content;
• Apple has no obligation to furnish maintenance or support for Fluento;
• if Fluento fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation in respect of Fluento;
• Apple is not responsible for addressing any claim by you or a third party relating to Fluento, including product liability, legal or regulatory non-compliance, or consumer protection claims;
• Apple is not responsible for investigating, defending, settling or discharging a third-party claim that Fluento infringes intellectual property rights;
• you comply with applicable third-party terms when using Fluento, and you represent that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.

If you installed Fluento from Google Play, Google Play's Terms of Service also apply to your download and purchases, and Google is not a party to this agreement.

17. Changes to these terms

We may update these terms. The date at the top changes, and for a significant change we will tell you in the app before it takes effect. Continuing to use Fluento after that means you accept the updated terms.
